Quick answer
Yes, Bildungsurlaub is usually tax deductible in Germany when the Spanish course is job-relevant: the course fee, flight and stay then count as Werbungskosten with no upper limit. The Bundesfinanzhof decides by weighing all the circumstances, and a course in another EU country cannot be judged more strictly than the same course in Germany.

Can you actually deduct a Bildungsurlaub course from German tax?
Yes, if the course is job-relevant. Section 9(1) sentence 1 EStG defines Werbungskosten as any expense that serves to acquire, secure or maintain your income, and professional training is squarely inside that definition. Unlike a first vocational qualification or a first degree, which section 9(6) EStG generally excludes from Werbungskosten, further training (Fortbildung) for someone already in work has no ceiling: whatever is job-relevant counts in full. How that interacts with the flat-rate allowance is explained further down.
So the question that matters is not whether the course happens to be taken as statutory Bildungsurlaub, but whether it serves your job. Your employer’s approval of the leave and the tax office’s view of the expense are two separate questions, decided by two separate bodies: your state’s Bildungsurlaub law on one side, the Finanzamt on the other. The same material helps with both: the afternoon “Spanish for work” programme and the seminar programme document the professional link. See the Bildungsurlaub Spanish course in Málaga for how the course itself is structured.
What has German case law said about language courses abroad?
In its ruling of 10 April 2002 (VI R 46/01, BStBl. 2002 II p. 579), the Bundesfinanzhof set the test: whether a language course is job-related is decided by weighing all the circumstances of the individual case. It is job-related in particular when the very next step in your career already requires the language. Even a course that only teaches the basics can count as Werbungskosten if the work you are aiming for needs qualified language skills. That case concerned a French course in Germany; the ruling on courses abroad followed two months later.
For courses abroad, EU law adds a second layer. On 28 October 1999, the European Court of Justice ruled in Vestergaard (Case C-55/98) that it breaches the freedom to provide services guaranteed by the EU treaty for a member state to impose stricter conditions on the deduction of training costs just because the course took place in another EU country rather than at home. The Bundesfinanzhof adopted that line in its ruling of 13 June 2002 (VI R 168/00, BStBl. 2003 II p. 765) and dropped its earlier, stricter scrutiny of language courses abroad: the deduction cannot be refused on the ground that the course took place in another EU member state, and the higher cost of travelling abroad does not by itself point to a private motive. For a Bildungsurlaub Spanish course in Málaga, that means the Spanish location is not, by itself, a reason to refuse the deduction.

What exactly counts: course fee, flight, stay and meals?
Five cost types can come into play, and the tax office treats them differently.
| Cost | How the tax office treats it | With our course |
|---|---|---|
| Course fee | Fully deductible once the course is job-relevant | €350 for 5 days, €650 for 10 days |
| Flight | Deductible; split by time if you add private holiday days | No fixed price, see the worked example below |
| Accommodation | Deductible, also split if part of the trip is private | Homestay from €239 (double) or €290 (single) a week |
| Meal allowance | BMF flat rate for the days away, no itemised receipts needed | €34 a full day, €23 on the arrival or departure day (Spain, 2026) |
| Transfer, materials, certificate | Deductible; mostly already €0 with us | Transfer €65; enrolment, materials, placement test and certificate €0 |
The course fee is the simple part: you pay a fixed price, and once the professional link is established it is deductible in full. The flight is where it gets more interesting. In its Großer Senat decision of 21 September 2009 (GrS 1/06, BStBl. 2010 II p. 672), the Bundesfinanzhof abandoned its old rigid ban on splitting mixed-purpose travel costs. Since then, travel costs can be split between the professional and the private share of a trip whenever that share can be worked out on a reasonable basis, for example the number of course days against any extra holiday days. Fly out purely for the course and fly straight back, and the flight is normally job-related in full.

Meals follow a rule of their own. Because the course takes place away from your normal place of work, you can claim the meal allowance (Verpflegungsmehraufwand) set out in the BMF’s foreign travel cost letter for the days you are there, as long as your employer does not reimburse it to you tax-free. For Spain outside Madrid, Barcelona, the Canary Islands and Palma de Mallorca, which covers Málaga, the BMF letter of 5 December 2025 sets the 2026 rate at €34 for a full calendar day abroad and €23 for the arrival and departure day. You do not need itemised receipts for this; you simply apply the flat rate. If meals are included in the price of your accommodation, that share does not count as accommodation cost, because the flat rate already covers food; ask us before you book what your accommodation includes.

How does this actually play out on your tax return?
The tax office deducts a flat-rate allowance automatically, the Arbeitnehmer-Pauschbetrag. For 2026 it is €1,230 a year (section 9a EStG). The government’s draft Einkommensteuerreformgesetz 2027 (Bundestag document 21/8235 of 28 September 2026) would raise it to €1,430 from the 2027 tax year. That is still only a bill: as of 28 October 2026 the Bundestag and Bundesrat have not passed it. Plan on €1,230 for 2027 until the increase actually applies.
You get that allowance regardless, without a single receipt. It is not added to your actual costs but used instead of them: the tax office applies whichever is higher. So the Bildungsurlaub course only counts in full once your total Werbungskosten for the year, commuting, work equipment and everything else included, exceed the allowance. If you are already above it without the course, every euro of the course reduces your taxable income. If you have few other Werbungskosten, part of the course simply absorbs an allowance you would have had anyway. The expenses go on Anlage N of your German income tax return, in the Werbungskosten section; the exact line number changes from year to year, so the official instructions for the current Anlage N show the right one.
A worked example: what does this mean for our Málaga course?
Take a one-week Bildungsurlaub: 5 days of class from Monday to Friday, arriving the Sunday before and leaving the Saturday after. For the flight we make one assumption: the price of a return flight from a German airport to Málaga depends heavily on departure airport, airline and booking date, so we use €150. That is an assumption for the sum, not a price we charge; put in your real fare.
| Item | Amount | Note |
|---|---|---|
| Course fee (5 days) | €350 | our prices page |
| Flight (assumption) | €150 | assumption, not our price |
| Airport transfer | €65 | optional |
| Homestay, double room, 1 week | €239 | single room: €290 |
| Meals (2 × €23 + 5 × €34) | €216 | BMF rate for Spain, 2026 |
| Total Werbungskosten | €1,020 | €1,071 with a single room |
For 10 days (2 weeks) the course fee and accommodation scale up, but the flight and transfer stay a single trip. Whether the weekend between the two course weeks counts as job-related is something the tax office may see differently; the sum below includes it:
| Item | Amount |
|---|---|
| Course fee (10 days) | €650 |
| Flight (same assumption) | €150 |
| Airport transfer | €65 |
| Homestay, double room, 2 weeks | €478 |
| Meals (2 × €23 + 12 × €34) | €454 |
| Total Werbungskosten | €1,797 |
These totals are not a tax refund, they are the amount you can claim as Werbungskosten; how much tax that actually saves depends on your personal marginal rate and on your other Werbungskosten for the year. See the full breakdown on our Málaga prices page and for homestays in Málaga; a full 5-day week with no public holiday is easiest to plan from the Málaga course calendar.

What proof does the tax office actually want?
The tax office does not ask for approval in advance, but it can request evidence later, so it pays to keep the right documents from the start. Keep these four: the seminar programme, which shows the professional side of the course (target group, learning goals, lesson times, daily topics); the certificate of attendance we issue on your last day with your lessons and level; the invoice for the course and, if you booked it with us, accommodation; and your flight booking or boarding pass as proof of the travel dates and cost. You get the seminar programme from us anyway for your employer application and the certificate on your last day, so keep a copy of both for your tax file.
One distinction matters here: recognition as Bildungsurlaub under your state’s law and recognition as Werbungskosten by the tax office are two separate processes run by two separate bodies. The state checker on our Bildungsurlaub page shows the status for your state, and we send the recognition proof for your state before you pay. The tax office, by contrast, only cares about the professional link, not about which state law applies.
What if you add private days to the trip?
Then things change, and it is better to know in advance than to hear it from the tax office. Extend your stay with private days on the beach or on day trips, and the course fee stays fully deductible, but the flight and the accommodation have to be split by time, under the 2009 Großer Senat ruling. In practice, with 5 course days and 2 extra private days, you would claim roughly five sevenths of the flight and the accommodation only for the course days, not the full amount. The meal allowance can only be claimed for the days that are professionally motivated in the first place.
That is not a reason to skip the private days. Málaga is worth visiting on its own terms. It is simply a reason to keep course days and private days clearly separated in your own records, with the dates on your certificate of attendance as the anchor. If in doubt, your tax adviser can confirm exactly how your own case should be split. If you want to keep learning job-relevant Spanish once the Bildungsurlaub week is over, without the deadlines the law attaches to it, our Business Spanish course in Málaga picks up where it leaves off.
Frequently asked questions
Can I deduct my Bildungsurlaub course in Málaga from my German tax return?
Usually yes, if the course is job-relevant. The course fee, flight and accommodation then count as Werbungskosten with no upper limit. The exact classification depends on your individual case, so check with a tax adviser if you are unsure.
What exactly counts as Werbungskosten for a Bildungsurlaub course?
The course fee, the flight, the accommodation and a meal allowance under the BMF flat rate for the days you are there. If you add private days, you split the flight and accommodation by time.
Does the course need a professional link for the tax office to accept it?
Yes. Since the Bundesfinanzhof ruling of 10 April 2002, the decision rests on weighing all the circumstances, for example whether the next step in your career needs Spanish. Our afternoon “Spanish for work” programme and the seminar programme supply that evidence.
Does the fact that the course is in Spain count against me?
No. The European Court of Justice ruled in 1999 that a course in another EU country cannot be subject to stricter rules than the same course in Germany, and the Bundesfinanzhof adopted that line for German practice in 2002.
Can I deduct the flight to my Bildungsurlaub course?
Usually in full, if you travel only for the course. If you add private holiday days, you split the flight cost by the time share between course days and private days.
How much is the Werbungskostenpauschale in 2026 and 2027?
In 2026 the flat-rate employee allowance is €1,230 a year. A government bill would raise it to €1,430 for 2027, but as of 28 October 2026 the Bundestag and Bundesrat have not passed it, so plan on €1,230 for now.
Can I claim a meal allowance for the days I am in Málaga?
Yes, through the BMF’s flat rate for foreign business travel, with no itemised receipts. For Spain the 2026 rate is €34 for a full day and €23 for the arrival and departure day.
Which documents should I keep for the tax office?
The seminar programme, the certificate of attendance, the invoice for the course and accommodation, and your flight booking or boarding pass. We send you the first two anyway for your employer.
Does my employer have to pay my travel costs before I can deduct them?
No. Your employer usually grants the paid leave while you pay the course fee yourself, and you then claim those costs as Werbungskosten. Anything your employer reimburses to you tax-free cannot be deducted on top.
Is this page tax advice?
No. This article gives general information about the legal position, not advice for your individual case. For a binding assessment, ask a Steuerberater or a Lohnsteuerhilfeverein.
How do you start your own calculation now?
Request the seminar programme, since it documents the professional side for your employer and the tax office alike, run your own total with the figures above, and keep the certificate of attendance, the invoice and the flight receipt for your tax return. On recognition by state, the position stays the same: the course is recognised as Bildungsurlaub in 14 German states, every one except Bavaria and Saxony. The state table on our Bildungsurlaub page shows yours, and we send the recognition proof for your state before you pay.
