1. Legal Notice This Legal Notice governs the use of the website and services of VAMOS Academy, in accordance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI). Accessing or using the website implies full acceptance of these Terms and Conditions. 2. Data Protection and Privacy VAMOS Academy complies with the General Data Protection Regulation (GDPR) and the Spanish LOPDGDD. Personal data is used exclusively for academic, administrative, and contractual purposes. Images and voice recordings are considered personal data. They will only be used with explicit written consent, never through general acceptance on the website. Data will not be used for commercial or promotional purposes without explicit consent. Students may exercise their rights of access, rectification, erasure, opposition, limitation, and portability through the channels provided (email, web form, or postal address). 3. Cancellation and Refund Policy (Courses) 3.1 General Principles All cancellations must be submitted in writing. The following fees are non-refundable: registration, courier fees, bank charges, insurance, accommodation deposits, and materials. Approved refunds are processed within a maximum of 14 calendar days. Refunds are issued to the original payer using the original payment method, unless otherwise agreed. A €90 administrative fee applies to all cancellation or change requests. 3.2 Student-initiated Cancellation 14 days or more before the course start date: Tuition fees are refunded in the form of a voucher valid for 12 months at any VAMOS Academy location. Less than 14 days before the start date: No refund is granted. After the course has started: No refund is granted. Force majeure: With supporting documentation, the Academy may offer a partial refund or postponement. Only the unused portion of tuition may be refunded, minus non-refundable charges. 4. Right of Withdrawal (Distance Contracts) 4.1 Exercising the Right Students who purchase services online or at a distance have 14 calendar days from the contract date to withdraw without providing a reason. The request must be submitted in writing. 4.2 Effects of Withdrawal All amounts paid will be refunded using the same payment method. Refunds will be issued within 14 calendar days from receipt of a valid withdrawal request. If the student requested the course to begin during the withdrawal period, the proportional cost of services already provided will be deducted. 4.3 Exceptions The right of withdrawal does not apply to: Courses already started when the student expressly requested the service to begin during the withdrawal period. Fully delivered services when the student has expressly consented to waive the right of withdrawal. Accommodation bookings managed through third-party providers once the reservation has been confirmed. Services with specific dates or execution periods. 4.4 Prior Information Before contracting, students receive clear information about the withdrawal right, its timeframe, procedure, and exceptions. 5. Academy-initiated Cancellation If VAMOS Academy cancels a course, the student will receive a full refund of tuition fees paid, excluding non-refundable charges. Alternative course options may be offered; acceptance of an alternative waives the right to a refund. 6. Accommodation Policy 6.1 Homestay Refund available if cancelled 14+ days before arrival. If cancelled with fewer than 14 days, 1 week of accommodation will be charged. 6.2 Shared Apartments Refund available if cancelled 30+ days before arrival. If cancelled between 16 and 29 days, 1 week of accommodation will be charged. If cancelled 15 days or fewer before arrival, no refund is granted. 6.3 Deposits The accommodation deposit (15% of the total booking) is non-refundable once the reservation is confirmed. 7. Academic and Operational Terms Classes are held Monday to Friday, in the morning and/or afternoon. Evening courses run in fixed 4-week blocks with specific start dates. A placement test is required before starting any course. Accommodation is available only for programmes of 20+ lessons per week. Students must attend at least 85% of classes. Misconduct may result in expulsion without refund. Photos and videos will only be taken and used with explicit consent in compliance with GDPR. 8. Liability and Force Majeure The Academy is not liable for loss, damage, or injury, including services provided by third parties (accommodation providers, activity partners, etc.). The Academy is not liable for failure to fulfil obligations due to events beyond its reasonable control (force majeure), including but not limited to fire, floods, pandemics, strikes, terrorism, or government restrictions. In such cases, postponements or partial refunds may be offered at the Academy's discretion, limited to unused tuition. 9. Code of Conduct Students must attend at least 85% of weekly classes. Respectful behaviour toward classmates, staff, teachers, and hosts is mandatory. The Academy may expel students for misconduct or endangering others, without refund. Students are responsible for any damage caused to property. Students must comply with local laws and customs. 10. Final Provisions These Terms and Conditions apply to students and agents. Enrolment implies full acceptance of these Terms. VAMOS Academy may update these Terms at any time; the latest version will always be available on the official website. 11. Group Formation and Conversion to Private Lessons Group courses require a minimum number of students of the same level to open. If the minimum number is not met on the start date: - The group course will automatically be converted into private lessons.- The following equivalence will apply: every 2 hours of group classes will be converted into 1 hour of private tuition.- The student will follow the adjusted schedule until the equivalent hours are completed.- This conversion does not entitle the student to a refund, as the service is still delivered in an adapted format.
