Bildungsurlaub Refused? Valid Grounds, Deadlines and What to Do Next

Quick answer

Your employer may refuse Bildungsurlaub only on the grounds your state's law lists, mainly operational needs that stand in the way or, in some states, other employees' priority holiday requests, and in most states the refusal must be in writing. Our course is recognised in 14 German states, all except Bavaria and Saxony, so check the stated reason before you plan your next step.

A refusal feels final, but it does not have to be. Your employer cannot turn down a Bildungsurlaub application for any reason they like: your state’s law sets out which grounds are valid, and often also the form and timing in which the refusal has to reach you. This post covers both: which grounds are lawful and which are not, what the state laws say about the form and timing of a refusal, and what to actually do if your Bildungsurlaub Spanish course in Málaga has just been turned down.

What grounds can your employer give for a refusal?

The law allows only a few grounds, and “we’d rather you didn’t” is not one of them.

Operational needs. This is the central ground in the state laws. Most speak of “zwingende” (compelling) operational needs, Baden-Württemberg and Hesse of “dringende” (urgent) ones, others of “wichtige” (important) needs or simply operational reasons; the exact wording is in your state’s law. It means, for example, that your absence would leave an important deadline, a production line or a project without enough staff, not simply that the week is inconvenient or that HR is busy. The more specific and concrete the stated reason, the more likely it is to hold up.

Other employees’ priority holiday requests. Some state laws also cover the case where several employees have applied for the same period and not everyone can be away at once. Whether this applies in your case is set by your own state’s law, not by a general company rule.

Formal grounds. According to the overview by the Standing Conference of Education Ministers (KMK), an application can also fail if it was submitted too late or the course is not recognised. Some states also have special rules for small businesses or a cap on leave days per company and year.

What the law does not list. A personal opinion about the course or a general dislike of Bildungsurlaub is not listed as a refusal ground in the state laws. Whether recognition is in place for your state is settled with our proof, as the recognition section below explains.

This article is not legal advice. Check your specific case with your Betriebsrat (works council) or a lawyer.

Does the refusal have to be in writing, and by when?

States differ a lot here. Three examples, backed by official sources:

State What the law says about a refusal Source
Brandenburg A refusal, with reasons, must generally reach you in writing within 2 weeks of your application Brandenburg Ministry of Education, Youth and Sport, Bildungszeit für Beschäftigte
North Rhine-Westphalia If the employer refuses, they must tell you in writing, with reasons, within 3 weeks of your notice Standing Conference of Education Ministers (KMK), Bildungsfreistellung in den Ländern
Lower Saxony (from 1 Jan 2027) The decision must be in text form; if your employer has neither approved nor refused by 4 weeks before the course, the leave counts as approved Lower Saxony Ministry for Science and Culture, Bildungszeit from 2027
Other states with a law Each state law sets its own form and timing for a refusal; check the wording for your state Standing Conference of Education Ministers (KMK), Bildungsfreistellung in den Ländern

Whatever your state: follow up in writing if you hear nothing within 1 to 2 weeks, and ask for a written answer that names the actual reason. That is not a formality, it is your record if you need to challenge the refusal later or start a second application round. Application deadlines by state are in our guide on how to apply for Bildungsurlaub.

Is the refusal because the course is not recognised in your state?

Missing recognition is a possible refusal ground under the state laws, so it is worth clearing up this point first. Our Bildungsurlaub Spanish course in Málaga is recognised in 14 of the 16 German states, all except Bavaria (no educational leave law) and Saxony (its Qualifizierungszeitgesetz only starts on 1 January 2027). We send the recognition proof for your state before you pay.

So if your employer’s stated reason is “the course is not recognised in our state,” it is worth a second look: the course is recognised in 14 states, and we supply the proof. You can always see the current status and the notes for your state in the state checker on our Bildungsurlaub page; this does not mean we can promise your employer will approve, that decision stays with them.

Only two cases are genuinely “not recognised”: Bavaria, because it has no law, and Saxony, until its new law takes effect. For Saxony, we will apply for recognition as soon as that becomes possible; until then we cannot promise recognition there.

What should you do after a refusal?

Four steps, in this order.

1. Ask for the specific reason, in writing. Several state laws explicitly require reasons, for example in Brandenburg and North Rhine-Westphalia, and without a reason you cannot check the refusal. Ask for a short written explanation if you have not received one.

2. Talk to your works council, if your company has one. The Betriebsrat knows how staffing and scheduling actually work and can judge whether the stated reason is realistic compared with past cases, and mediate with HR on your behalf. This is often the fastest route to a second, better-informed decision, without you having to push back alone.

3. Propose other dates. If the reason concerns that specific week, for example because too many colleagues would be away at once, a different start date often solves it on its own. The course starts on every Monday that begins a full 5-day week; weeks with a Spanish public holiday are not suitable. The Málaga course calendar shows which weeks are open. Submit the new date again, before the deadline.

4. Check whether your entitlement carries over, only where the state law actually allows it. In states with 10 days over 2 years, such as Brandenburg, Bremen, Hamburg or Rhineland-Palatinate, the days are already spread across two years. In some states with an annual entitlement, including Berlin, Hesse, Saarland, Saxony-Anhalt and Schleswig-Holstein, an unused year’s entitlement can also be combined with the next year’s; the exact conditions are set by your state’s law. In Thuringia, according to the KMK overview, the entitlement can be carried over once into the following year if your employer refused a leave request. This does not undo an unlawful refusal for this year, but it helps if time for your preferred date has simply run out.

If the refusal still stands after these steps, and the stated reason was genuinely reasonable from the business’s side, some employers still grant the week as voluntary training leave, for example using regular holiday days or unpaid leave. That is not a legal entitlement, but it can be a workable fix, with the same course and the same documents.

What mistakes should you avoid after a refusal?

  • Booking anyway, before there is a resolution. Never pay for a course date you might not be allowed to take.
  • Accepting a verbal refusal as final. Ask for a written answer with a reason; in most states the refusal has to be in writing anyway.
  • Letting the deadline for a new application slip. Count the full deadline for your state again from your new preferred date, not just a few extra days.
  • Assuming your state rules out the course entirely. That is only true for Bavaria and, until 2027, Saxony. In the other 14 states the course is recognised; the state checker on our Bildungsurlaub page shows the status for each.
  • Escalating alone, without involving your works council. Where one exists, it is the most direct route to a second, informed decision.

How does Vamos help after a refusal?

We cannot promise your application will be approved, and we cannot promise an official Bescheid or case number either, only your state’s authority or your employer can issue those. What we can supply: the recognition proof for your state before you pay, the full seminar programme and, written for your HR department, the one-page summary for HR: course and provider, timetable, the society and politics component, the certificate, who pays, and a contact at our school.

If your application lacked something, such as the seminar programme or the exact number of hours, send these documents with your new application. Ask us directly if HR has a specific concern; we reply within 1 working day.

Frequently asked questions

Can my employer simply refuse Bildungsurlaub?

No, not for any reason they like. An on-time application for a recognised course can be refused only on the grounds the state law lists, mainly operational needs that stand in the way and, in some states, other employees’ priority holiday requests. A personal opinion about the course is not listed as a ground.

What are lawful reasons to refuse Bildungsurlaub?

Mainly operational needs, which depending on the law must be compelling or urgent, for example if too many staff would be away at the same time. Depending on the state, other employees’ priority holiday requests, a missed deadline, missing recognition or small business rules can also count. The exact grounds are set out in your state’s law.

Does my employer have to give reasons in writing?

In most states the refusal has to be in writing, and several laws explicitly require reasons. Brandenburg sets generally 2 weeks after you apply, North Rhine-Westphalia 3 weeks after your notice. In Lower Saxony the decision must be in text form from 2027.

What happens if my employer does not respond at all?

It depends on the state. From 2027, Lower Saxony’s rule is that if your employer decides neither way by 4 weeks before the course, the leave counts as approved. In other states, follow up in writing after 1 to 2 weeks.

Can missing recognition be a reason to refuse?

Yes, missing recognition is a possible refusal ground under the state laws. Our course is recognised in 14 of the 16 states, all except Bavaria (no law) and Saxony (law from 2027). We send the proof for your state before you pay.

In principle yes: disputes arising from employment are decided by the German labour courts (Arbeitsgerichte). Whether it is worth it in your case is something to check first with your works council, your trade union or a lawyer specialising in employment law. This article is not legal advice.

What can I do if my company has no works council?

Ask for the refusal in writing with a reason, check that reason against your state’s law, and if in doubt bring in a lawyer. Proposing a new date that removes the stated reason often helps too.

Can I carry unused days over to next year?

Only where your state’s law allows it. States with 10 days over 2 years, such as Brandenburg, Bremen, Hamburg or Rhineland-Palatinate, already build this in; some states with an annual entitlement also allow combining it with the following year. In Thuringia, a one-off carry-over into the following year is possible after a refusal.

Then it is not legally a refusal, it is a missing entitlement. Some employers still grant the week voluntarily, with the same course and the same documents, just without a legal basis.

Can I apply again after a refusal?

Yes. Clarify the stated reason first, propose a different date if needed, and submit the new application again before the deadline, with the seminar programme, the employer letter and the recognition proof.

How do you move forward from here?

Ask for the stated reason in writing, check it against your state’s law, and bring in your works council or a lawyer if you are unsure. If the reason only concerns your preferred week, a new date is often the fastest route.
