The Spanish purchase process is safe when it is checked, and expensive when it is not. Here is the full route from offer to keys, the checks that actually protect you, the real notary and tax costs, and why your lawyer should never be the one the agency recommends.

Why an independent lawyer, not the agency’s

Spain does not oblige you to use a lawyer to buy property. The notary is mandatory; the lawyer is your choice. That is precisely why the choice matters. Everyone else at the table is paid when the sale closes: the estate agent earns commission from the seller, the developer’s lawyer protects the developer, and the in-house or recommended lawyer an agency offers you sits inside the same commercial relationship that only gets paid if you sign. None of them is engaged to tell you to walk away.

An independent abogada colegiada owes her professional duty to one party: you. Her job is to find the reasons not to buy, and only clear you to sign when there are none left. In a market where most foreign buyers cannot read the nota simple, do not know what an ITE certificate is, and are wiring six figures across borders, that single structural difference, who the lawyer answers to, is worth more than any other decision in the purchase. It is also why we never take referral fees from agencies or developers on purchases we represent.

Simple test: if the person recommending a lawyer earns money when you complete the purchase, that lawyer is not independent. Choose one who gets paid the same whether you buy or walk away.

The full purchase process, offer to keys

A standard resale purchase in Andalucia runs through six stages. First, the offer and reservation: once a price is agreed, the agency will usually ask for a reservation deposit, commonly 3,000 to 10,000 EUR, to take the property off the market. This is the moment to involve your lawyer, before signing, because reservation documents are often drafted to favour the seller and can make the deposit hard to recover.

Second, due diligence, covered in detail below. Third, the arras contract: the private purchase contract, normally with a 10% deposit under the penitential arras regime, where the buyer who withdraws loses the deposit and the seller who withdraws returns it doubled. Signing arras before due diligence is complete is the single most common and most expensive sequencing mistake foreign buyers make.

Fourth, preparation for completion: obtaining or confirming your NIE, opening a Spanish bank account where needed, arranging funds and any mortgage, and granting a power of attorney if you will not attend in person. Fifth, completion at the notary: the escritura publica de compraventa is signed, the price is paid, usually by banker’s draft or verified transfer, and you receive the keys. The notary checks identity, capacity, and legality of form, but the notary does not do your due diligence; that distinction surprises many northern European buyers.

Sixth, after completion: payment of the purchase taxes within their deadlines, registration of your title at the Land Registry, which takes a few weeks, and the transfer of utilities, community membership, and direct debits into your name. A typical resale purchase runs eight to twelve weeks from accepted offer to keys; off-plan purchases follow the developer’s build calendar with stage payments instead.

What real due diligence checks

Due diligence is not one document; it is a cross-check of everything the seller and the registries say about the property. Our standard file covers:

  • Nota simple from the Land Registry: current ownership, charges, mortgages, embargoes, and liens that would travel with the property
  • Cadastral cross-check: whether the physical property, its size, and its boundaries match what the registry and cadastre record, since mismatches block later steps including tourist-licence registration
  • Community of owners: certificate that the seller owes no community fees, review of minutes for approved works or looming special levies
  • Municipal position: IBI (property tax) payment status, planning and urbanistic compliance, first occupation licence, and any enforcement files
  • Building condition paperwork: the ITE building inspection certificate where the building’s age requires one, and the energy performance certificate
  • Contract review: reservation, arras, and escritura drafts, corrected before signature rather than argued about after
  • Off-plan additions: developer’s licence, land title, and the bank guarantee that must secure every stage payment you make before delivery

We sell this as a standalone product at 750 EUR for buyers who only want the checks, and it is included in full buyer representation. The 100 EUR initial diagnostic is the short version: a rapid review of the nota simple and the offered contract that tells you within days whether the purchase deserves a full file or a fast exit.

NIE, bank account, and buying by power of attorney

Every foreign buyer needs a NIE, the foreigner identification number, to complete a Spanish property purchase, pay the taxes, and register title. It does not grant residency; it is a tax identifier, and both EU and non-EU buyers need one. Getting it in Malaga means navigating the cita previa system, which is exactly the queue-hunting we handle daily; see our dedicated NIE guide.

You do not need to be in Spain to buy. A power of attorney, signed before a Spanish notary or before a notary abroad with an apostille, lets us obtain your NIE, open the bank account, sign the arras, and complete at the notary on your behalf. A significant share of our purchases complete with the buyer never leaving home before collection day, and the POA route is often faster than coordinating international travel around a notary date. Payment itself must still flow through verifiable banking channels, and completion funds are normally held ready in a Spanish account before the notary appointment.

Buying property no longer gets you a visa

The myth that refuses to die: that buying a 500,000 EUR property gives you Spanish residency. It did, until 3 April 2025, when Organic Law 1/2025 abolished the investor golden visa for new applications. Since that date, no property purchase, at any price, creates any visa or residency entitlement in Spain. Only people who already held golden visas before abolition can renew under transitional rules.

If an agent or promoter tells you otherwise in 2026, walk away from the advice and possibly from the agent. Buying property remains completely open to non-residents, and owning here is entirely lawful without residency; what has changed is only the link to immigration status. What the purchase really costs: notary, registry, taxes

Budget roughly 10-14% on top of the purchase price in Andalucia for a resale, somewhat more for a new build. The components:

Mortgage buyers get one structural break: since the 2019 mortgage law, the bank pays the notary, registry, and gestoria costs of the mortgage deed itself, and the AJD on the loan. Non-resident mortgages typically cap at 60-70% of valuation, so plan deposits accordingly. Sellers, for their part, bear the plusvalia municipal and their own capital gains position, which is their lawyer’s problem, not yours, provided your contract says so.

Taxes after the purchase: the part nobody budgets

Ownership starts a small annual tax calendar. Every owner pays IBI, the municipal property tax, and community fees where there is a community of owners. Non-resident owners additionally file Modelo 210, the non-resident income tax return, every year, even if the property earns nothing: Spain imputes a notional income to non-resident-owned property and taxes it, typically a few hundred euros a year on an average apartment. Rent the property out and the same Modelo 210 declares the rental income instead, with EU/EEA residents able to deduct expenses and others taxed on gross.

Miss these filings for long enough and they surface at the worst moment, usually as a retention when you sell. The pitfalls that actually cost buyers money

After enough files, the same problems recur. Registry-cadastre mismatches: the flat measured 92 m2, the registry says 78 m2, and now the tourist licence registration for your buy-to-let plan is blocked until the records are reconciled. Inherited debts: community fees and certain charges follow the property, not the person, so the previous owner’s arrears become yours at completion if nobody certified them. Illegal works: that lovely enclosed terrace may be an unlegalised extension with a demolition order waiting in a municipal file.

Off-plan risk deserves its own line: never pay a stage payment that is not covered by a bank guarantee or insurance policy in your favour, which the developer is legally obliged to provide. If the developer fails, that guarantee is the difference between recovering your money and joining a creditors’ list. And the quietest pitfall of all: signing arras “to secure the property” before checks are done. Ten percent of a Costa del Sol property is a very expensive way to discover an embargo. Every one of these is findable in advance, which is the entire argument for the due diligence stage this page keeps returning to.

Buying in Spain, questions answered

Do I need a lawyer to buy property in Spain?

Legally no, only the notary is mandatory. Practically yes: the notary checks the legality of the deed, not the property’s debts, licences, or defects. An independent lawyer is the only person in the transaction whose sole job is protecting the buyer, and the cost is small against the sums at risk.

Can foreigners buy property in Spain without residency?

Yes. There are no nationality or residency restrictions on buying Spanish property. You need a NIE number, a way to pay through verifiable banking channels, and you must file the non-resident tax returns that ownership triggers. Owning property does not itself grant any right to live in Spain.

Does buying property in Spain still get you a golden visa?

No. The investor golden visa was abolished for new applications on 3 April 2025 under Organic Law 1/2025. No purchase made since that date creates any residency entitlement, at any price. Only pre-existing golden visa holders can renew under transitional rules. Residency now runs through the ordinary visa routes.

How much are the total costs on top of the purchase price?

In Andalucia, budget roughly 10-14% extra. The main item is transfer tax at 7% on resales, or 10% VAT plus around 1.2% stamp duty on new builds, then notary fees of roughly 400-1,000 EUR, Land Registry fees of 350-900 EUR, processing costs, and your independent legal fee.

What is an arras contract and how much is the deposit?

The arras is the private purchase contract signed before completion, normally with a 10% deposit. Under the usual penitential arras, a buyer who withdraws loses the deposit and a seller who withdraws must return it doubled. It should only ever be signed after due diligence is complete.

What is a NIE and do I need one to buy?

The NIE is Spain’s foreigner identification number, and yes, every foreign buyer needs one to complete a purchase, pay the taxes, and register title. It is a tax identifier, not a residence permit. We obtain NIEs for buyers routinely, including from abroad under power of attorney.

Can I buy a Spanish property without travelling to Spain?

Yes. With a power of attorney signed before a notary, in Spain or abroad with an apostille, we can obtain your NIE, open the bank account, sign the arras, and complete at the notary on your behalf. Many of our purchases complete with the buyer abroad throughout.

What does due diligence on a Spanish property include?

The nota simple with ownership and charges, cadastral cross-check, community debt certificate and minutes, IBI and planning status, first occupation licence, ITE inspection and energy certificates, and full contract review. For off-plan, it adds the developer’s licence, title, and the bank guarantee securing your stage payments.

What taxes do non-resident owners pay after buying?

Annual IBI municipal property tax, community fees where applicable, and the Modelo 210 non-resident income tax return every year, even with no rental income, because Spain imputes notional income to non-resident-owned property. If you let the property, Modelo 210 declares the rental income instead.

Who pays the estate agent, the notary, and the taxes?

The seller normally pays the agency commission and the plusvalia municipal. The buyer pays the transfer tax or VAT, and by custom most notary and registry costs of the purchase deed. On a mortgage, the bank pays the notary, registry, gestoria, and stamp duty of the loan deed.

Is buying off-plan in Spain safe?

It can be, if every stage payment you make is secured by the bank guarantee or insurance the developer is legally required to provide, and the licence and title checks come back clean. Never pay a peseta of stage money without seeing that guarantee in your favour first.

Can I rent my Spanish property to tourists after buying?

Only with the right registration, and in Andalucia the rules tightened sharply: capacity caps, community consent requirements for new registrations in apartment buildings, and a suspension of new licences in Malaga city. Check feasibility before you buy, not after; a registry-cadastre mismatch alone can block registration.
