This guide is for anyone considering or already going through the process of applying for asylum or another form of international protection in Spain, and for the people supporting them, family members, friends, or advisers trying to understand what actually happens after an application is lodged. It is a serious, often difficult process, and we have tried to write about it plainly, without minimising what is at stake and without overselling what a lawyer, paid or free, can promise to change about the outcome.

Asylum covers people fleeing persecution based on race, religion, nationality, political opinion, or membership of a particular social group. A related status, subsidiary protection, covers people who do not meet that specific definition but who would face a real risk of serious harm if returned to their country. Both are assessed together in the same application.

The stages of the process

The Spanish asylum procedure generally moves through these stages, though timing between them varies considerably depending on caseload and circumstances:

• Initial application, at a border post, police station, or dedicated asylum office (OAR)

• Admission to procedure, a decision on whether your case will be formally examined

Many asylum claims are well served by this route, and we tell every prospective client about it clearly before discussing our own paid service.

The honest tradeoff is time and continuity. Turno de oficio lawyers carry high caseloads, which can mean less preparation time devoted to any single file, and cases are sometimes handled by different duty lawyers at different stages rather than one person following the case throughout. For many claims, that does not change the outcome. For some, it does.

When paid, dedicated counsel makes sense

We recommend clients consider dedicated paid counsel mainly in these situations:

• The claim involves complex facts, multiple incidents, or evidence that needs careful organisation and presentation
