Register as Autonomo Spain 2026: RETA, Fees & Quotas
Autonomo is Spain’s self-employed registration, mandatory the moment you invoice regularly from here, whether you are freelancing on a digital nomad visa or starting a local side business. Here is RETA, the tax forms, the 2026 quota tiers, and what to actually deduct.

Registering as autonomo means signing up for RETA, Spain’s self-employed Social Security regime, and filing Modelo 036 or 037 with the tax agency to declare your activity. Since 2023 your monthly RETA quota is based on your real net income, sorted into roughly fifteen 2026 brackets rather than a flat fee, with reduced rates for new autonomos in their first years. Our registration fee is 150 EUR as a one-off, or free when you join our 59 EUR per month advisory plan that also covers your quarterly filings.
What RETA registration actually means
RETA, the Regimen Especial de Trabajadores Autonomos, is the Social Security scheme that covers Spain’s self-employed workers. If you carry out an economic activity in Spain on a regular basis, whether that is freelance consulting, running a small shop, or invoicing international clients from a laptop in Malaga, you are legally required to register, regardless of whether you also hold a salaried job elsewhere. Registration is what gives you access to public healthcare as a self-employed worker, builds your state pension contributions, and opens access to sick leave, maternity, and paternity benefits calculated on your quota bracket.
Registration is not a formality you can quietly skip because your income is modest or irregular. Spanish authorities have tightened enforcement in recent years, particularly around foreign residents invoicing overseas clients while living in Spain, and back-dated RETA liability plus penalties is a genuinely painful way to discover the rule applies to you. If you are already earning from Spain-based work without being registered, the sooner that is fixed the smaller the exposure.

Modelo 036 and Modelo 037: the tax side
Alongside RETA, you must register your economic activity with the Agencia Tributaria using Modelo 036 or Modelo 037. Modelo 037 is the simplified version, suited to straightforward individual activities with standard VAT treatment. Modelo 036 is the fuller form, required for more complex situations: certain VAT exemption categories, activity that crosses EU borders, specific professional activity codes, or changes to an existing registration that the simplified form does not cover. Filing the wrong one, or filing with the wrong activity code (epigrafe), is a common source of downstream VAT and invoicing problems, so we confirm the correct form and code before submission rather than defaulting to whichever is faster to file.
- NIE and proof of your residency or work-authorised status
- Chosen economic activity code (epigrafe) matching what you actually do
- Fiscal address in Spain
- VAT regime selection, including any applicable exemption
- RETA registration reference, filed in parallel with the tax registration
The 2026 quota tier system
Since 2023, autonomo Social Security contributions are no longer a flat monthly fee; they are based on your real net monthly income, sorted into roughly fifteen brackets, each carrying its own monthly quota. At registration you choose an estimated bracket based on your projected net income for the year, and you can adjust that bracket several times during the year as your actual income becomes clearer, with a year-end reconciliation against your real net earnings that can produce either a refund or an additional payment. New autonomos typically qualify for a reduced flat quota during their first months to first years, before shifting onto the full income-based bracket system.
| Net monthly income (approx.) | 2026 tier position | Who tends to land here |
|---|---|---|
| New autonomo, reduced flat rate period | Lowest tier, flat reduced quota | First registration months, regardless of income |
| Modest freelance income | Lower-middle brackets | Part-time freelancers, early-stage businesses |
| Solid, established freelance income | Middle brackets | Full-time consultants, established small businesses |
| High net income | Top brackets | High earners, some digital nomad freelancers |
Choosing the right starting bracket matters: under-declaring your expected income to sit in a lower bracket creates a reconciliation bill (plus potential penalty) at year end, while over-declaring simply overpays your quota through the year for no benefit. We help clients pick a realistic bracket and adjust it as the year progresses rather than guessing once and leaving it.
Digital nomad visa holders and autonomo registration
Whether a digital nomad visa holder needs to register as autonomo depends entirely on how they are paid. If you are an employee of a single foreign company, working remotely from Spain under a standard employment contract, your foreign employer’s social security coverage (sometimes formalised through an A1-style certificate) can often apply instead of Spanish RETA registration for a defined period, since you are not technically self-employed. If instead you invoice multiple clients directly, or work as a freelancer rather than an employee, that income is generally treated as Spanish self-employed activity, and RETA plus tax registration applies in the same way it would for a local freelancer.
This distinction trips up a meaningful number of digital nomad visa holders who assume the visa itself settles the question. It does not; the visa governs your right to reside and work, while RETA and tax registration depend on the actual structure of how you are paid. If your work situation is a mix, part payroll and part direct freelance invoicing, that combination needs a specific look rather than a generic answer. See our Digital Nomad Visa Spain guide for the visa side of this.
Invoicing, deductions, and quarterly filings
Autonomo invoices need your full name, NIF, fiscal address, invoice number in sequence, VAT treatment, and, for many cross-border services, specific wording about reverse-charge VAT for EU business clients. Deductible expenses commonly include office rent or a proportional home-office deduction, professional software and subscriptions, business travel, a percentage of vehicle and phone costs genuinely tied to the activity, and your RETA contributions themselves. Every deduction needs a proper invoice in your name, not a bank statement line or a simple receipt, and it has to be plausibly connected to your registered activity; this is one of the most commonly misapplied areas in autonomo bookkeeping and one of the first things reviewed if the tax agency ever asks questions.
Filings run on a quarterly cycle: VAT (Modelo 303) and income tax withholding on account (Modelo 130 or 131, depending on activity type) every three months, an annual VAT summary (Modelo 390), and your annual personal income tax return the following spring. Zero activity in a quarter does not exempt you from filing; missing a deadline triggers a penalty even with nothing to declare, which is the single most common avoidable cost we see among autonomos managing their own paperwork.

Autonomo vs SL: which fits your situation
Autonomo and forming an SL company solve different problems, and the right choice depends on your revenue, your liability exposure, and your growth plans rather than a fixed rule. See the decision table below, and our full Company Formation Spain guide if an SL looks like the better fit once your business grows past the point where autonomo’s unlimited personal liability becomes an uncomfortable risk.
| Autonomo | SL company | |
|---|---|---|
| Setup cost | Low, near-immediate | Higher, several weeks |
| Liability | Personal, unlimited | Limited to company assets, with narrow exceptions |
| Best for | Testing an idea, solo freelance income | Growing revenue, hiring, outside investment, higher liability exposure |
| Ongoing admin | Quarterly self-employed filings | Quarterly VAT, annual accounts, formal bookkeeping |

Autonomo questions, answered
How much does it cost to register as autonomo in Spain?
Our registration fee is 150 EUR as a one-off service, or included free when you join our 59 EUR per month ongoing advisory plan covering quarterly filings and invoicing support. There is no separate government fee to become autonomo; the cost that follows registration is your monthly RETA Social Security quota, which depends on your real net income under the 2026 tier system.
What is RETA and do I have to join it?
RETA is Spain’s Social Security scheme for the self-employed. Registration is mandatory the moment you carry out an economic activity in Spain on a regular basis, whether or not you also hold a salaried job elsewhere. RETA funds your healthcare access, pension contributions, and sick leave or maternity and paternity benefits as a self-employed worker.
What are Modelo 036 and Modelo 037?
Both are tax registration forms declaring your economic activity, VAT and income tax withholding regime, and fiscal address. Modelo 037 is the simplified version for straightforward activities; Modelo 036 is the fuller version required for more complex situations. We confirm which one applies before filing.
How does the 2026 autonomo quota tier system work?
Since 2023, contributions are based on your real net monthly income, sorted into roughly fifteen brackets, each with its own monthly quota. You choose your estimated bracket at registration, adjust it during the year, and reconcile against actual net income at year end. New autonomos get a reduced flat rate in their first years.
Do digital nomad visa holders need to register as autonomo?
It depends on your work structure. Employees of a single foreign company under the digital nomad visa generally are not required to register, since their employer’s home social security coverage can apply. Self-employed digital nomad visa holders invoicing clients directly typically do need RETA and tax registration.
What can autonomos deduct as business expenses?
Office rent or a proportional home-office deduction, professional services and software, business travel, a percentage of vehicle and phone costs, and RETA contributions themselves. Each expense needs a proper invoice in your name, not just a receipt, and must be genuinely tied to your registered activity.
How often do autonomos file tax returns?
Quarterly VAT (Modelo 303) and income tax withholding (Modelo 130 or 131), plus an annual VAT summary (Modelo 390) and the annual income tax return the following spring. Missing a quarterly deadline triggers penalties even with zero activity to declare.
Should I register as autonomo or form an SL company?
Autonomo suits testing an idea, solo freelance income, and lower liability situations. An SL suits growing revenue, hiring staff, outside investors, and shielding personal assets from business liability. See our decision table and Company Formation Spain guide for the full framework.
Can I be autonomo and employed at the same time?
Yes, this is pluriactividad. You register for RETA alongside your standard employee Social Security regime, and in your first years of combined activity you may qualify for a reduced RETA quota under the pluriactividad discount.
What happens if I stop being self-employed?
You must formally deregister from both RETA and the tax registration (baja) as soon as you stop your activity. Simply stopping invoicing without filing the baja leaves you accruing RETA quotas and filing obligations indefinitely.
Do I need a Spanish bank account to invoice as autonomo?
Not legally required for every invoice, but almost every practical workflow assumes one: RETA quota payments are collected by direct debit, and Spanish clients expect Spanish IBAN details on your invoices. See our non-resident bank account guide if you have not opened one yet.
What is the difference between the one-off fee and the monthly advisory plan?
The 150 EUR one-off fee covers registration only; quarterly filings and bookkeeping are then your own responsibility. The 59 EUR per month plan includes registration free, plus every quarterly filing, invoicing templates, and deduction guidance for as long as the plan runs.
Can a non-resident register as autonomo in Spain?
You need Spanish tax residency status or a valid permit that allows self-employed activity, an NIE, and RETA eligibility. Most digital nomad visa holders, status-changed non-lucrative visa holders, and registered EU citizens can access self-employed registration once their permit allows it.
