Please read the following Terms and Conditions carefully before proceeding with your booking. These Terms and Conditions are subject to change without notice, from time to time in our sole discretion. Vamos Spanish will endeavor to communicate the most updated Terms and Conditions to our students when changes occur.
1. Definitions
'Vamos Spanish' or ‘the school’ shall mean Vamos Spanish Academy. 'You’ or ‘student’ shall mean the person in whose name the booking is made and shall include the person or persons on whose behalf the same is made. 'Force Majeure' shall mean any event outside Vamos Spanish Academy's control, including but not limited to war and civil strife etc., which prevents the prompt performance of its obligations.
2. General Information
General information included in the website (www.vamospanish.com/santiagochile) is for help and guidance, hereafter called 'the website'. The contract incorporating these conditions shall be governed by Argentine law and any matters arising out of it shall be subject to the jurisdiction of the Courts of Argentina, Ciudad Autonoma de Buenos Aires.
3. Spanish Courses
3.1
A regular group class lasts 4 hours per day, including a 20-minute break. Due to the written placement test and/or the oral interview which usually takes place on the first day of class, especially in the case of last minute sign up, class time on the first day may be slightly reduced. The student is responsible for sending Vamos Spanish their completed Placement Test at least one week prior to the first class. Vamos Spanish does not accept any liability for classes and/or hours missed, or for assignment to the wrong level due to not turning in the Placement Test on time. No refunds will be given where classes are missed due to testing.
3.2
The minimum number of students to start any group class is two. In the rare event that the student wants to join a group class but he/she is the only one at his/her level, Vamos Spanish will offer the student private classes of equal value. These private classes will still be treated as a group class with regards to both class planning and administration. If another student at the same level signs up, the class will immediately resume the regular 4 hours per day schedule.
3.3
There is no rescheduling for group classes once classes have started.
3.4
If a student is absent due to reasons including but not limited to sickness, travel etc., there is no refund or rescheduling of group class unattended with or without prior notice.
3.5
Private classes require at least 24 business hours to schedule or reschedule. Also see point 13.3.
3.6
When there is a high volume of students, Vamos Spanish reserves the right to introduce afternoon group classes. Vamos Spanish will notify students when such option is available but the student schedule will be ultimately determined by Vamos Spanish.
3.7
When taking online classes, it is the student's responsibility to make sure he/she has all the necessary technical and non-technical requirements ready, including but not limited to a reliable internet connection, a computer with audio and video capabilities in good working condition, the correct browser installed, and a learning space with minimal noise and interruptions etc. Vamos Spanish is not liable to compensate for any loss of class times due to any technical or non-technical issues incurred on the student's side.
3.8
Online class students may view, read and also print any or all screen and materials shared for personal use only in taking online classes.
3.9
All materials provided and used for all of Vamos Spanish classes cannot be reproduced, reused, modified, stored, published, redistributed or exploited commercially in any manner without permission from Vamos Spanish.
4. No Show and Late Arrival Policy
4.1
Classes start and end as scheduled by Vamos Spanish. If a student arrives late, the class time missed is not refundable nor can it be rescheduled.
4.2
In any situation where the student(s) do not show up for their scheduled class and they are the only student(s) in the class, Vamos Spanish reserves the right to release the teacher after 30 minutes of waiting unless notification of late arrival has been made in advance. Once the teacher has been released, the class is automatically cancelled, no rescheduling of class will be made, and no refunds will be given.
5. Public Holidays
5.1
Vamos Academy closes on public holidays. During any week where there is/are national holiday(s), no classes will take place on that day. One more hour will be added to the group classes during the remaining days of that week; thus, the group class’ hours will be from 9AM – 2PM. Private classes will be rescheduled based on Vamos Spanish’s availability.
5.2
The Argentine government can and does create and announce new public holidays at anytime during the year with little or no notice. While Vamos Spanish will do its best to inform the students about public holidays, it is the student’s responsibility to look up all the public holidays in Chile when they book their travel.
6. Accommodation
6.1
The minimum for an accommodation booking is one week (7 nights). Any extra nights that are less than the one-week unit will be calculated separately. There is no refund if the student checks out early or spends less time in the accommodation than was paid for during their stay. This includes any trips taken during the stay.
6.2
Vamos Spanish will do its best to assign the student to an accommodation that matches as closely as possible to the preferences indicated in the Registration Form. However, the final assignment will depend on availability at the time of booking due to season, hosts, and other factors that are out of the control of the school.
6.3
If the student is unhappy with his/her first assigned accommodation due to reasons concerning his/her health, safety or discomfort, the student will have the first 3 days to make a relocation request with a plausible reason. However, if the reason for relocation is a concern that the student did not inform Vamos Spanish of at the time of registration and/or booking, Vamos Spanish will assist to relocate the student but the student will be responsible for any extra charges incurred for the relocation.
6.4
Vamos Spanish reserves the right to relocate or terminate a student’s accommodation arrangement without a refund if the student violates the Code of Conduct or the host’s house rules, creates disruptions to the host’s living environment, and/or if a substantial amount of reasonable complaints are made from the host. The abuse of alcohol, the use of illegal drugs, or the presence of overnight guests without permission of the host are not allowed and will result in immediate termination of accommodation without a refund.
7. Travel Documents and Insurance
The student is fully responsible for having all necessary valid travel documents, travel insurance, and medical insurance. Any non-compliance and any resulting damages are the sole responsibility of the student.
8. Prices
The prices stated on the website are the official charges; prices on any 3rd party websites, printed flyers, brochures, advertisements, or other materials are for indication only. Prices are subject to change at any time without notice. If prices change and only partial payment has been received for a booking, it is at the sole discretion of Vamos Spanish to decide whether or not to honor the price from the time of booking upon completion of the full payment.
9. Discounts
9.1
Discounts for group classes only apply to the full 20-hr week at its regular price. There will be no discounts for any partial week due to reasons including but not limited to holidays or late registration.
9.2
Discounts that are offered directly by Vamos Spanish cannot be combined with any other discounts offered by third parties, unless stated otherwise. The long term discount is per person and it only applies when multiple consecutive weeks are booked and paid for at the same time. Any additional weeks will be calculated as a new transaction and a new booking.
10. Booking and Payment
10.1
Due to the limited capacity of each class and accommodation, spots are available on a first come, first served basis. Therefore, a spot is not guaranteed and booking is not finalized until full payment has been processed and a booking confirmation has been issued. Full payment must be made before the first day of class or the check-in day of accommodation. Vamos Spanish reserves the right to refuse a student from starting class or moving into the accommodation until full payment has been received.
10.2
In the case that payment for accommodation is made less than 7 business days prior to the check-in date, Vamos Spanish will try its best but cannot guarantee that the student will be able to move into accommodation on the desired date as requested.
10.3
All paid Spanish course programs, accommodation and/or any item booked through Vamos Spanish are non-transferable.
11. Special Requests
Vamos Spanish must be informed of any and all special requests at the time of Registration.
12. Airport Transfer
12.1
If a student has booked the Airport Transfer service with Vamos Spanish, the student is responsible for providing Vamos Spanish with the correct arrival flight information (including arrival airport, airline name, flight number, arrival date and time) at least 5 business days before the arrival day. If the student fails to provide such information correctly and promptly, Vamos Spanish reserves the right to charge the student for any extra fee incurred due to last minute booking or changes to the transfer.
12.2
The airport transfer fee includes a reservation made in the student’s name and a driver who will bring the student directly to their destination.
13. Changes by the Student
13.1
If a student wants to make changes to a booked and paid program (including classes, accommodation, airport transfer and/or any other services provided by Vamos Spanish) before their program has started, the request must be made to Vamos Spanish in writing, and Vamos Spanish reserves the right to charge an administration fee of up to US$100 per person per change to cover the additional administration involved.
13.2
If a student wants to change to his/her Spanish course program from one type to another, a change fee of US$45 will be applied. If this request is made less than 5 business days before the change is expected to occur, then Vamos Spanish will do its best to make the requested changes, but it will also depend on the school’s schedule and availability.
13.3
If a student wants to reschedule his/her private class, the request must be made at least 24 business hours before class starts and the rescheduled time will depend on the school’s schedule and availability. If this requirement is not met, the class will not be rescheduled and no refund will be given.
14. Cancellation and Refund Policy
14.1
If a student wants to cancel his/her booked and paid program which may include classes, accommodation, airport transfer, or any other item booked through Vamos Spanish, the request must be made to Vamos Spanish in writing. The date of cancellation will be the date that Vamos Spanish receives such a request in writing.
Based on the date of cancellation, our Refund Policy will be:
• 15 or more days before the start date of the entire booked program – full refund minus an Administration Fee of US$50 plus any transaction fees incurred, including but not limited to merchant processing fees, payment transfer charges, and credit card charges, etc.
• Within 14 days before the start date of the entire booked program - refund of the paid program minus a cancellation fee equivalent to one (1) week of group classes, an Administration Fee of US$50 plus any transaction fees incurred, including but not limited to merchant processing fees, payment transfer charges, and credit card charges, etc.
• On or after the start date of the booked program - there is no refund. Also, see point 10.3.
14.2
For any situation not outlined in 14.1, the Refund policy will be applied at the sole discretion of Vamos Spanish.
14.3
Students have the option to convert the refunded amount into credit towards other products provided by Vamos Spanish.
14.4
All cancellations are final.
14.5
If a student fraudulently disputes a transaction with his/her credit card issuer, no refund will be granted and Vamos Spanish reserves the right to take legal actions.
15. Changes by Vamos Spanish
Vamos Spanish reserves the right to modify or cancel its program and services arrangements if unforeseen circumstances arise. If Vamos Spanish cancels or significantly changes the elements of a booked program due to force majeure, on or before the start date of such program, Vamos Spanish will inform the student as soon as possible and will put forth its utmost effort to arrange alternatives that are of equal value. If force majeure occurs while the program is in progress, Vamos Spanish will try to make reasonable alternative arrangements.
16. Liability of Vamos Spanish
Vamos Spanish is responsible for making sure that all programs and services are supplied as described and that they all reach reasonable standards. However, Vamos Spanish will not be liable for the failure or improper performance of these products and services where such failure or improper performance is attributable to a) the fault of the student, b) the unforeseeable or unavoidable actions of an unconnected third party, c) unusual and unforeseeable circumstances beyond the control of a service provider of Vamos Spanish, including force majeure.
17. Code of Conduct
Students are expected to behave respectfully towards others, including but not limited to fellow students, teachers, staff, accommodation hosts, flatmates and/or activity personnel, as well as to the property of others, including but not limited to the school building, shared facilities, and living environment. Additionally, students are expected to obey the laws and adapt to the customs of the country they travel in. The Code of Conduct is outlined as such and serves as a guideline for all Vamos Spanish students to follow.
A copy of the Code of Conduct will be provided to the students when one's booking is finalized. Vamos Spanish reserves the right to remove a student from his/her program and/or accommodation if such student violates the Code of Conduct. No refund will be given and the student must pay for any and all damages that may have been incurred.
18. Privacy Policy
Any and all personal information that is collected during the Vamos Spanish Registration process will be used for Vamos Spanish administration and booking purposes only. Vamos Spanish does not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide products or services requested by the student. Vamos Spanish may occasionally send news, such as information on our current events, special events happening in Chile during your stay, special promotions, etc., to your provided email address. You can reply to unsubscribe at any time.
